SONDE HEALTH PRIVACY POLICY

1. Introduction:
Welcome to Sonde Health! We are committed to protecting your privacy whenever you are using any Sonde product (the website www.sondehealth.com, the Sonde consumer app and the Sonde research app). We need to use your data to provide our service to you. Know that you can request to delete it at any time, however, your service will be affected.
The Sonde Mental Fitness, Sonde One, and other Sonde Apps (“App”) is owned and operated by Sonde Health, Inc. (“Sonde”, “we”, “us”, “our”, or the “Company”). Note that this Privacy Policy explains only how we collect, use, share information through the App. For more information on how we collect, use, and share information on our websites, including www.sondehealth.com, please contact Sonde at info@sondehealth.com.
This Privacy Policy applies to all Users of the App (“Users”). If you do not agree with any part of this Privacy Policy, you must not use the App. Your continued use of the App will constitute your acceptance of this Privacy Policy. Beyond the Privacy Policy, your use of the App is also subject to our Terms of Service. You can review the most recent version of this Privacy Policy at any time here. We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through the App, we will notify you through the App, by email, or other communication.
2. Information Collected:
We may collect a variety of information from or about you or your devices from various sources, as described below. We endeavor to comply with data minimization principles. In other words, through your use of the App, we try to collect and process only the minimal amount of personal information required to deliver the App to you.
Registration Information: Full use of the App requires that you create an account by providing us with information such as your full name, a valid email address, phone number, billing information, and a strong password.
Background Health Information: We may ask you to provide information about your general health and habits, such as whether you are a smoker, or whether you have asthma. You provide this information voluntarily, and we use it to make our service more accurate for you.
Communications: If you contact us directly, we may receive additional information about you. For example, when you contact our Customer Support Team, we will receive your email address.
Device Information: Whenever you use our App, we collect information from you, such as your IP address, referring URL, operating system, cookie information, GPS coordinates, and Internet Service Provider. We may also receive information about your mobile device, including various unique identifiers associated with your device, hardware type, and the version of your operating system. .
Location: We derive general information about your location from your IP address or global positioning system (GPS) sensors when you use our App.
Usage Information: When you access or use our App, we receive certain usage data. This includes information about your interaction with the App, for example, when you view or search content, when you create an account or log into your account through the App, or when you open or interact with the App. We may also collect user preferences around how your data may interact with other application programmers interfaces (APIs), for example, connecting your current location to the local smog index. This collection specifically includes records of your voice that you provide when using the App.
Information from Third-Party Services: If we provide the option to connect your account on the App to your account on another service, and you choose to do so, we may receive information from the other service. For example, if you connect to Facebook or Google or SurveyLex, we may receive information like your name, profile picture, age range, language, email address, and friend list. You can stop sharing the information from the other service with us by removing our access to that other service.
Payment and Card Information: The App may allow you to make a purchase or subscription. If this option is enabled and you choose to make a purchase through the App, you must provide certain information for identification and verification, such as your name, credit, debit or other card number, card expiration date, and CVV code. This information is encrypted and sent to the third-party payment processor on our behalf. We do not store this payment information. Note that third-party payment processors may retain this information in accordance with their own privacy policies and terms.
Application Progammers Interface Data – with your consent, we may also collect information from third-parties about you including health records (REDOX API), survey data (SurveyLex API), walking and exercise data (Fitbit or Apple Health Kit API), email services integrations (e.g. Gmail), messaging data (Twilio API), transcription data (Amazon Transcribe API), peoducticity tool data (Slack or Microsoft Teams API), and many others as we improve our services.
Google Analytics Data – we may store web beacons, cookies, and other data to measure your engagement with the application through web services and other applications. This is designed to help us better understand how you use the app to improve our services.
3. Use of Your Information:
We use the personal information we collect for the following purposes:
To Provide and Improve the App: We use the personal information we collect to provide, maintain, improve, and enhance the App. For example, we use the information to troubleshoot and protect against errors; perform data analysis and testing; conduct research and surveys; and develop new features and services.
To Communicate with You. We use your personal information when needed to send you Service notifications and respond to you when you contact us.
For Marketing and Advertising Purposes. We also use your personal information to promote new features or products that we think you would be interested in. You may manage your receipt of marketing communications from Sonde by clicking on the “unsubscribe” link located on the bottom of a marketing email. Additionally, you may send a request to info@sondehealth.com.
To Promote Safety and Security. We use the personal information we collect to promote the safety and security of the Services, our users, and other parties. For example, we may use the information to authenticate users, facilitate secure payments, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies.
For Compliance Purposes: Including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency.
4. Sharing Your Information
We share or sub-license the personal information we collect in the following circumstances:
Research Organizations: With your permission, we may share your information with research organizations who may use your information to inform and conduct various studies.
Vendors and Service Providers: We may share information with third party service providers that help us provide the App to you. Our service providers are given access to your information as is reasonably necessary to provide the App. The service providers we currently use help us with payment processing, advertising, analytics, disaster recovery, information technology, storage, audio processing and content delivery, among others.
For Legal Reasons or To Prevent Harm: We may disclose your personal information to comply with a law, regulation, legal process, or governmental request; to assert legal rights or defend against legal claims; or to prevent, detect, or investigate illegal activity, fraud, abuse, violations of our terms, or threats to the security of the App or the physical safety of any person.
De-Identified and/or Anonymized Information: We may privately publicly share, license, or publish information that is aggregated, anonymized, or de-identified, so that it cannot reasonably be used to identify an individual.
Affiliates and Mergers: We may share your information with our subsidiaries, affiliates, and companies acquired by or merged with us and our affiliates.
5. International Visitors
Our services are hosted in the United States and intended for visitors located within the United States. If you choose to use the App from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the App. By providing any information, including personal information, on or to the App, you consent to such transfer, storage, and processing.
6. Accessing, Editing, and Removing Your Information:
We give you the ability in the App to access and control your personal information, as described below, regardless of where you live. You may contact us at support@sondehealth.com to exercise any of those rights or follow the steps below.
Accessing and Deleting Data: By logging into your account in the App, you can access much of your personal information and request that we delete your personal information. You may contact us to receive a copy of the personal information we have about you. If you choose to delete your account, please note that while most of your information will be deleted within 7 (seven) days, it may take up to 30 (thirty) days to delete all of your information, like the data stored in our backup systems. This is due to the size and complexity of the systems we use to store data. We may also preserve data for legal reasons or to prevent harm.
Editing Data: You may change your personal information through the App. For instance, you can edit the profile data you provide. ·
7. Data Retention
We keep your personal information for as long as your account is in existence, because we need it to operate your account. We also keep your personal information and information about your use of the Services for as long as necessary for our legitimate business interests, for legal reasons, and to prevent harm.
8. Third Party Websites
We may post links to third party websites on our Service. Additionally, other materials made available through our Service may contain third-party website links or files. We do not endorse these third-parties or screen third-party websites or files for privacy or security issues. Please review the privacy policy and terms of service for each site you visit.
9. Security Measures
Sonde uses appropriate safeguards that are designed to protect the confidentiality, integrity, and security of personal information that we collect and maintain against accidental or unlawful loss, theft and misuse, unauthorized access, disclosure, alteration destruction, or any other type of unlawful processing. However, as the Internet is an inherently dangerous place, we cannot fully guarantee the security of personal information or other information transmitted to us through the App.
10. Medical Disclaimer
The App is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health providers with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have seen in this App. If you think you may have an emergency, call your doctor, go to the emergency department, or call emergency immediately. Reliance on any information provided by Sonde Health or our employees is solely at your own risk. IF YOU ARE THINKING OR EXPERIENCING SUICIDIAL THOUGHTS OR SEVERE DEPRESSION OR IF YOU ARE CONSIDERING HARMING YOURSELF OR OTHERS OR IF YOU FEEL THAT ANY OTHER PERSON MAY BE IN ANY DANGER OR IF YOU HAVE ANY MEDICAL EMERGENCY, YOU MUST IMMEDIATELY CALL THE EMERGENCY SERVICE NUMBER (911 IN THE US and 112 IN INDIA) AND NOTIFY THE RELEVANT AUTHORITIES.
11 Children’s Privacy
We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of the App is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at info@sondehealth.com.
